From experience, we understand that people are at the heart of every business.
Our Employment Law practice is structured to assist businesses in navigating the complex and evolving legal landscape that governs employer–employee relationships. We advise on all stages of the employment cycle – from recruitment and onboarding to workforce restructuring, collective bargaining, and litigation.
With a firm grasp of both Romanian and EU labor regulations relevant to this area, our approach combines legal precision with a deep understanding of workplace dynamics and business priorities.
Our employment lawyers work closely with HR departments, compliance officers, and executive teams to ensure strategies are not only legally sound but also aligned with corporate values, risk profiles, and operational realities.
The Employment practice at BACIU PARTNERS also includes a dedicated focus on immigration-related legal matters, in response to the increasing mobility of the global workforce. We assist corporate clients in ensuring full compliance with Romanian immigration laws, particularly when employing foreign nationals in Romania.
Our work focuses on:
- Drafting, updating, and negotiating individual employment agreements, internal regulations, workplace policies (including anti-harassment, diversity & inclusion, remote work, and non-compete clauses), as well as structuring expatriate frameworks and managing cross-border mobility schemes.
- Providing strategic legal advice in connection with individual and collective termination procedures, organizational restructuring, outsourcing arrangements, and business transfers (TUPE), with a focus on legal defensibility, reputational impact, and operational continuity.
- Advising on the legal structuring and implementation of complex compensation and benefits frameworks, including long-term incentive plans, employee stock option plans, deferred cash awards, and other bespoke remuneration mechanisms.
- Guiding clients through collective bargaining negotiations, employee representative consultations, and day-to-day industrial relations, including the design of engagement protocols and crisis mitigation strategies.
- Ensuring compliance with occupational health and safety standards, anti-discrimination laws and the broader regulatory framework governing workplace ethics, transparency, and corporate accountability at both national and EU levels.
- Supporting clients in conducting internal investigations, compliance audits, , and interactions with labor authorities, with a focus on prevention and strategic positioning.
- Representing clients in employment-related litigation and alternative dispute resolution proceedings.
- Providing strategic guidance on employer responsibilities in relation to workplace whistleblowing mechanisms, confidentiality and data protection in employment contexts, as well as compliance with health and safety regulations.
