Employee benefits in the Romanian legal framework: What are the common risks behind fringe benefits?

Employee benefits can play an important role in building a corporate culture, at large, and more specifically attracting and retaining talent. Their effectiveness depends primarily on how they are structured, documented and applied in practice.

In a recent contribution to one of termene.ro ‘s guides authored by journalist Amelia Turp, Adela Nuță provided her view on the legal considerations that companies should consider when designing and implementing employee benefit provided beyond standard salary schemes.

From an employment law perspective, several elements require particular attention:

  • the appropriate inclusion of benefits and the applicable conditions in employment agreements, collective bargaining agreements or internal regulations;
  • the use of clear, objective and documented eligibility criteria;
  • the consistent application of such criteria across relevant employee categories; and
  • the prevention of discrimination risks when different benefit packages are offered to different groups of employees.

As Adela explains, differentiation between employee categories is not, in itself, discriminatory. Employers may establish different benefit packages based on objective considerations such as role, level of responsibility or seniority. The legal risk arises when the distinction can’t be supported by a clear and documented rationale or when the established criteria are not applied consistently.

The analysis also highlights a broader practical point: employee benefits shouldn’t be treated as an informal addition to remuneration: their legal weight needs to be considered from the design stage and reflected accurately in the employer’s internal documentation and implementation processes.
