Data Protection in Romania: Good faith in data protection: principle and standard for transparency and accountability

On 15 September 2025, Adela Nuță joined the debate “Good faith in data protection: principle and standard for transparency and accountability” organized by JURIDICE.ro.

Her intervention addressed the practical challenges companies face when applying the GDPR principles of transparency and accountability, with emphasis on ensuring clarity for data subjects and on documenting processing decisions as proof of compliance.

As key conclusions to take forward, Adela underlined:

  • The need to avoid abusive or opaque practices (dark patterns) that undermine transparency and free consent, contradicting the principle of good faith in data processing.
  • That good faith is not expressly defined in the GDPR, but emerges indirectly from the interplay of fairness, transparency, and accountability.
  • That supervisory authorities may consider the operator’s good or bad faith when assessing sanctions, especially in relation to the design of interfaces and mechanisms that influence users’ decisions on personal data processing.
