As from 1 May 2025, several amendments brought by Regulation (EU) No. 2024/2822 amending Council Regulation (EC) No 6/2002 on Community designs and repealing Commission Regulation (EC) No 2246/2002 became applicable.
These amendments are part of a broader legislative initiative aimed at improving the protection of designs and aligning the legislation with the technological and industrial progress, given the implications brought by the digital age and the transition to 3D printing technology, and they concern, in essence,
- certain amendments to the applicable definitions and terms,
- amendments to the object of protection conferred by law to designs,
- new acts of use to which the design holder may oppose,
- new acts of use that can be made without the consent of the design holder, or
- the permanent character of the repair clause.
