As part of the WTR series EUROPEAN UNION | Legal updates: case law analysis and intelligence, Andreea Bende and Zsófia Judit Halmágyi, recently co-authored a piece titled “Addition of co-dominant distinctive element insufficient to avoid conflict with Louis Vuitton’s reputed LV logo“.
The thesis:
- Louis Vuitton Malletier opposed a figurative mark containing the interlaced letters ‘V’ and ‘Z’ in Class 33 based on its earlier LV mark
- The Opposition Division found that the signs were similar at least to a low degree, as the interlaced letters had a very similar structure and graphical representation
- Although the contested goods were dissimilar to those protected under the earlier mark in Classes 18 and 25 for which a reputation had been proved, a certain closeness between these could be established
