As part of the WTR series EUROPEAN UNION | Legal updates: case law analysis and intelligence, Andreea Bende and Zsófia Judit Halmágyi recently authored a piece titled “Fly me to the moon: the LUNAR OUTPOST case”.

The thesis:

  • The General Court has upheld an EUIPO decision finding that LUNAR OUTPOST was descriptive and lacked distinctiveness for goods/services in Classes 9, 12 and 39
  • The relevant public would understand the sign as referring to “a settlement on the moon”, and each of the goods/services at issue could be used in such a settlement
  • Whether settlements on the moon currently exist was irrelevant
