The Working Group on Intellectual Property (IP) within the Public Ministry, under the auspices of the National Institute of Magistracy (INM), and with the support of several IP-focused business partners, organized a one-day seminar that brought together judges, academics, and IP practitioners. The much-anticipated yearly gathering that took place on 10 November 2025 was dedicated to one of the core legal elements of copyright protection: originality.
Originality and Artificial Intelligence: Where Does Human Input End?
Ana-Maria Baciu joined the panel on “Originality and Artificial Intelligence: AI-generated or AI-assisted works.” Her intervention focused on providing a practical perspective on the rapidly transforming way we (should) understand creativity in law.
The key question explored was: how does the concept of originality evolve when human input, machine assistance, and automated outputs coexist within the same creative process?
Contributing to the larger discussion during the event, Ana-Maria outlined several key considerations, maintaining a consistent focus on the fact that originality remains the legal red thread that determines whether a work receives protection. Yet, its assessment becomes increasingly complex when creation is partially automated. AI-assisted creation raises multiple legal implications far beyond the answers the legal community can currently offer.
The event emphasized once again how the dialogue targeting multiple angles (law, creativity, and technology) is both urgent and increasingly intricate.
