Every year, BACIU PARTNERS organizes the Intellectual Property Moot Court Competition (MCC IP) alongside our partners at ELSA Bucharest.

But who makes all these possible? And what are their takeaway from the experience?

To answer these, in the spirit of the transparency and accessibility that define how we work, we invited the BACIU PARTNERS team members involved in this year’s edition into a series of open conversations about ideas, expectations, professional instincts and the subtle details that often remain behind the scenes of such initiatives.

Looking at this experience as a whole, what stood out to you regarding how the participating students approached this competition?

Denisa Drăgușin: Looking at this experience as a whole, one of the main highlights was the high level of engagement and seriousness with which the students approached the competition. They demonstrated not only a solid understanding of legal concepts in intellectual property law (a subject many of the participants had not yet studied at university), but also the ability to apply them practically, in a structured and well-argued manner.

When evaluating memorials or pleadings, where is the difference actually made between an answer considered simply “correct” and one that is truly convincing—even a memorable benchmark for that participant?

Denisa Drăgușin: The difference between a correct answer and one that is truly convincing, even memorable, stems from the curiosity shown in exploring the solution, as well as the depth and maturity of the analysis, which must be backed by solid research in both national and European doctrine and jurisprudence. In a remarkable written memorial, this research is not just formally cited; it is coherently integrated and effectively leveraged within the text. A correct answer identifies the issue and provides a solution supported by valid arguments. In contrast, a convincing answer goes a step further: it analyzes all possible angles, explores alternative interpretations, and anticipates the opponent’s counterarguments, seamlessly integrating them into its own argumentative structure.
